These Terms of Service ("Terms") are a binding agreement between you and Breathe With Sandy LLC ("Breathe With Sandy," "we," "us," or "our"). These Terms govern your access to and use of our websites, mobile applications, member dashboard, subscriptions, media library, community features, live event pages, email lists, and related services (collectively, the "Services").
By accessing or using the Services, creating an account, starting a trial, buying a subscription, joining a community feature, registering for an event, or clicking to accept these Terms, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Services. By using the Services, you represent that you meet this requirement and that you have legal authority to enter into these Terms.
The Services are intended for personal wellness, education, and entertainment. They are not intended for children.
2. Accounts and Security
Some features require an account. You agree to provide accurate information, keep your login credentials confidential, and promptly update account information when it changes. You are responsible for activity under your account unless the activity results from our failure to use reasonable security measures.

3. Breathwork and Health Safety
Breathe With Sandy provides breathwork, music, movement, meditation, educational content, and community experiences. We are not a medical provider, and the Services do not provide medical advice, diagnosis, treatment, psychotherapy, emergency care, or a substitute for professional healthcare.
Use breathwork responsibly
- Consult a qualified healthcare professional before starting breathwork if you have any medical condition, are pregnant, take medication, have a history of seizures or epilepsy, have cardiovascular or respiratory conditions, have high or low blood pressure, have a severe mental health condition, or are unsure whether breathwork is safe for you.
- Stop immediately if you feel faint, dizzy, numbness that concerns you, chest pain, panic, shortness of breath beyond normal practice intensity, or any other distress.
- Do not practice breathwork while driving, operating machinery, in water, standing in unsafe places, or in any situation where losing awareness could harm you or others.
- Breath holds, intense breathing patterns, and transformational breathwork may not be suitable for everyone. You are responsible for choosing practices appropriate for your body and circumstances.
You voluntarily assume the risks associated with breathwork, movement, live events, and related practices. Nothing in these Terms limits liability that cannot be limited under applicable law.
4. Subscriptions, Trials, Billing, and Cancellation
Paid Services may be offered through Stripe checkout, Apple App Store in-app purchases, Google Play in-app purchases, RevenueCat-powered purchase flows, or other payment processors. Prices, plan features, trial periods, billing intervals, taxes, and renewal terms are shown at checkout or in the app before purchase.
Auto-renewal
Unless stated otherwise at checkout, subscriptions automatically renew until canceled. By starting a paid subscription or trial that converts to a paid subscription, you authorize the applicable payment provider to charge the recurring fees, taxes, and other disclosed amounts for each renewal period.
Cancellation
You can cancel future renewals through the billing method used to subscribe. For Stripe web subscriptions, use the billing portal or account billing settings where available. For Apple or Google purchases, cancellation must be managed through your Apple ID or Google Play account. Cancellation stops future renewals but does not automatically refund past charges.
Refunds
Payments are non-refundable except where required by law, where expressly stated by us, or where the applicable app store or payment processor grants a refund under its policies. Apple and Google control refunds for purchases made through their stores.
Changes
We may change prices, plans, trial availability, and features from time to time. We will provide notice where required by law. If you do not agree to a changed paid plan, you may cancel before the change takes effect.
5. Live Events, Tickets, and Waitlists
Event dates, venues, artists, schedules, ticket availability, and event details may change. If you register interest, join a waitlist, or buy a ticket through us or a third-party ticketing provider, additional terms may apply at checkout.
Unless otherwise stated for a specific event, tickets are subject to the refund and transfer rules displayed at purchase. We may refuse admission or remove participants whose conduct is unsafe, disruptive, unlawful, or inconsistent with event guidelines.
6. Community Features and User Content
The Services may include community posts, messages, replies, profile information, notes, playlists, feedback, support communications, or other content you submit ("User Content"). You retain ownership of your User Content, but you grant Breathe With Sandy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, moderate, and use it as needed to operate, secure, improve, and provide the Services.
You are responsible for your User Content. Do not submit content that is unlawful, harmful, harassing, abusive, deceptive, infringing, invasive of privacy, spam, or otherwise inappropriate for a wellness community. Do not share emergency requests, medical records, or sensitive information that you do not want processed by the Services.
We may remove content, restrict features, suspend accounts, or ban users when we believe it is necessary to protect users, the Services, our rights, or the integrity of the community.
7. License to Use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial use.
You may not copy, download, rip, redistribute, sell, sublicense, publicly perform, stream outside the Services, scrape, reverse engineer, bypass access controls, share login credentials, or use our content or software except as expressly allowed by the Services. Offline downloads, where available, are licensed only for in-app personal playback and may stop working if your subscription ends, your account is terminated, the content is removed, or technical restrictions require it.
8. Intellectual Property
The Services, including breathwork sessions, videos, audio, music, text, designs, software, logos, trademarks, images, compilations, and other materials, are owned by Breathe With Sandy, Sandy, licensors, or service providers and are protected by intellectual property laws.
No rights are granted except those expressly stated in these Terms. "Breathe With Sandy" and related names, marks, and branding may not be used without permission.
9. Prohibited Conduct
You agree not to:
- Use the Services for unlawful, harmful, fraudulent, or abusive purposes.
- Interfere with or disrupt the Services, servers, security systems, or networks.
- Access or attempt to access another user's account or private data.
- Use bots, scraping, automated extraction, or bulk downloading without our written permission.
- Upload malware or content that infringes rights or violates law.
- Resell, share, or commercially exploit the Services or content without permission.
- Misrepresent affiliation with Breathe With Sandy, Sandy, or our partners.
10. Third-Party Services
The Services may link to, integrate with, or rely on third-party services such as payment processors, app stores, authentication providers, hosting providers, email providers, video or audio platforms, analytics providers, and social platforms. We are not responsible for third-party services, and their own terms and policies may apply.
11. Service Changes and Availability
We may add, modify, suspend, or discontinue parts of the Services at any time. We aim to keep the Services reliable, but we do not guarantee uninterrupted access, error-free operation, continued availability of any specific content, or compatibility with every device or operating system.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your account or access if we believe you violated these Terms, created risk for others, infringed rights, failed to pay amounts owed, or used the Services in a way that could harm Breathe With Sandy or the community.
Sections that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, dispute terms, and provisions about User Content already processed as part of the Services.
13. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will meet your expectations, produce specific wellness outcomes, be uninterrupted or error-free, or that content will always be available.
14. Limitation of Liability
To the fullest extent permitted by law, Breathe With Sandy LLC and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, or personal injury arising from your misuse of the Services.
To the fullest extent permitted by law, our total liability for claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid to Breathe With Sandy for the Services in the three months before the event giving rise to the claim, or (b) USD $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Breathe With Sandy LLC and its owners, officers, employees, contractors, licensors, and service providers from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your User Content, your misuse of the Services, your violation of these Terms, or your violation of law or third-party rights.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law rules, except where local consumer law requires otherwise.
Before filing a claim, you agree to contact us at [email protected] so we can try to resolve the issue informally. If we cannot resolve it, disputes will be brought in the state or federal courts located in California, unless applicable law gives you the right to bring a claim elsewhere.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date and, where required, provide additional notice. Your continued use of the Services after updated Terms take effect means you accept the updated Terms.
